Environment Agency approves Drax carbon capture permit
Drax Power Limited has been granted a variation to its environmental permit so it can add carbon capture to its bioenergy plant near Selby. The Environment Agency says the decision followed a public consultation on its draft ruling earlier this summer. If you are not used to permit language, this can sound dry and distant. It is not. This is the paperwork that decides what a large energy site is allowed to do, what checks it must pass and what legal promises it has to keep if it wants to keep operating.
In the Environment Agency’s account, the key question was not whether carbon capture sounds like a good idea in the abstract. Area Environment Manager Ian Foster said the consultation comments and evidence had been reviewed, and that the agency was satisfied robust environmental protection could be met. The regulator says it can only grant a permit or variation when it is satisfied that the operator can comply with the conditions and has the right systems in place to avoid harm to the environment, human health and wildlife. That is why the agency says Drax had to show it has met, and will continue to meet, the mandatory conditions written into the permit. Put simply, this is less about branding and more about whether the legal and technical tests have been met.
The route to this decision was not quick. Drax first applied in May 2023, and the Environment Agency opened a consultation so the public could comment on the application. During that review, the agency decided there was not enough information, so it asked for a more detailed assessment. Drax then submitted a revised air emissions risk assessment, including information on substances that could be formed in the carbon capture plant. A second consultation followed in February 2025, and a third and final consultation on the draft decision took place earlier this summer. That long timeline matters because it shows the process was revised and retested, not waved through in one step.
It helps to pause on what carbon capture actually means here. The basic idea is that carbon dioxide is removed from waste gases, usually by using a solvent that absorbs it, so that far less of it ends up in the atmosphere. Drax wants to capture the carbon dioxide produced during electricity generation and stop the majority of it from being released into the air. The company’s plan is for the captured carbon dioxide to be transported and stored permanently under the North Sea. The most important line in the Environment Agency statement is also the easiest to miss. Under environmental law, the agency may only refuse a permit if the application fails one or more legal requirements, including where there would be an unacceptable impact on the environment or harm to human health.
